Some Details Released in Resignation

SPRINGFIELD, Ohio-- A resignation agreement between Lynn Marshall and the Clark County Auditor's Office ended any internal investigation against the former administrator and stipulated Marshall's withdrawal of appeals to the State Personnel Board of Review, according to documents released by Auditor George Sodders' attorney on Monday, July 7.

The auditor's office had begun an internal audit against Marshall concerning his attendance at some village and township meetings for which he claimed compensation for overtime and mileage, Sodders said. "All the evidence wouldn't necessarily hold up," he said. "At best, we were unable to confirm Marshall's attendance at some meetings, but it doesn't mean that he wasn't there."

The auditor said his office had been looking into the matter before a News-Sun article detailing Marshall's mileage and overtime compensation was published in June. Marshall was paid nearly $6,000 in mileage reimbursement and $12,378 in overtime in 2006, according to the auditor's office payroll documents.

The resignation agreement also stipulated that Marshall would withdraw three complaints he filed with the state alleging that Sodders demoted him from administrator to special projects coordinator as retaliation for being a whistleblower. He publicly criticized Sodders' handling of the county's 2007 $1.2 million mass reappraisal by Appraisal Research Corp.

Marshall's last day was June 27 and he will use accrued vacation time through July 18. He will be paid out $1,006.78 for 28 unused vacation hours, Sodders said. Marshall did not return phone calls seeking comment Monday.

"It was a good resolution on both sides," Sodders said. "Personnel decisions are not the easiest to make, and this one, I'm sure, was not easy for either party."
